Our commitment to your privacy

Vistancia Orthodontics is committed to protecting the privacy of your health information. This Notice applies to all records of your care, including both dental and medical services provided at our practice. We are required by law to maintain the privacy of your Protected Health Information (PHI) and to provide you with this Notice of our legal duties and privacy practices.

Arizona-specific privacy and consent provisions

In addition to federal HIPAA requirements, we comply with applicable Arizona laws and AHCCCS (Arizona Health Care Cost Containment System) requirements, including:

  • AHCCCS Members: We will verify eligibility and may share necessary information with AHCCCS and its contractors for payment, care coordination, quality review, and program integrity purposes.
  • Minors (Under 18): A parent or legal guardian generally has the right to access a minor's records and authorize treatment. However, Arizona law allows minors to consent to certain services (such as emergency care and, in limited cases, specific outpatient services). When a minor lawfully consents to their own care, we may limit parental access to related records as required by law.
  • Divorced/Separated Parents: We will follow court orders and applicable Arizona law regarding access to a child's health information. Absent a court order to the contrary, either parent may have access.
  • Confidential Communications for Dependents: Upon request, and when reasonable, we will accommodate alternative communication methods (e.g., separate billing address) to protect confidentiality.
  • Substance Use Disorder Records: If applicable, certain records may receive additional protections under federal and state law, requiring specific authorization before disclosure.
  • Public Programs & Reporting: We may disclose information to state agencies as required for public health reporting, abuse/neglect reporting, and other legally mandated programs.
